Sponsor/Administrator: "Sponsor": Green Mountain Coffee Roasters, Inc., 33 Coffee Lane, Waterbury, VT 05676. "Administrator": US Sweepstakes & Fulfillment Company, 625 Panorama Trail, Suite 2100, Rochester, NY 14625.
Timing: The Sweepstakes begins at 12:00:00 AM Eastern Time ("ET") on May 21, 2012, and ends at 11:59:59 PM ET on August 21, 2012 (the "Promotion Period"). Administrator's computer is the official timekeeping device for this Sweepstakes.
Eligibility: Restricted to Trade. During the Promotion Period, participating office supply distributors of Green Mountain Coffee Roasters, Inc. (“GMCR” or the “Sponsor”) will deliver a Promotion Kit (the “Promotion Kit”) to office managers or persons in similar decision-making roles (each, an “Office Manager”) of select office customers (each, a “Participating Office”) at GMCR’s sole election. Only Office Managers in good standing and employed by Participating Office, who have received a Promotion Code from the Promotion Kit for the Green Mountain Coffee® “Meet the Cool Side of K-Cup® Pack” Sweepstakes, who are legal residents of the 50 United States or the District of Columbia and who are 18 years of age or older are eligible to participate. Employees, officers and directors of the Sponsor and its subsidiaries, affiliates, independent sales distributors, advertising and promotional agencies and immediate family members (spouse, parents, children and siblings and their respective spouses regardless of where they live) and those living in the same household with such individuals, whether related or not, are not eligible to participate. Internet access and valid email account necessary to enter and win.
How to Enter: A total of 112,400 Game Pieces will be available for distribution to Office Managers. OFFICIAL GAME PIECE DISTRIBUTION BEGINS ON MAY 21, 2012 AND ENDS ON AUGUST 21, 2012 (OR SOONER IF SUPPLIES OF OFFICIAL GAME PIECES ARE DEPLETED). Sponsor reserves the right to give away Game Pieces through advertising channels other than as specified herein at Sponsor’s own discretion. Game Pieces may not be transferred, duplicated or shared. Game Pieces are null and void and will be rejected if not obtained in accordance with these Official Rules and through legitimate channels; or if any part of the Game Piece is determined by the Independent Sweepstakes Administrator (the “Administrator”), retained by the Sponsor to ensure fair play throughout the promotion period, to be illegible, reproduced, counterfeited, mutilated, transferred, sold, exchanged, or tampered with in any way; or if any Game Piece and/or promotion related materials contain printing, production, typographical, mechanical or other errors. Game Pieces containing printing or other errors may be replaced with another Game Piece at the sole discretion of the Sponsor, while supplies last.
To obtain a Game Piece:
During the Game Piece Promotion Period, at any Participating Office: Receive a Game Piece from the Promotion Kit, while supplies last. As the Promotion progresses, some Green Mountain Coffee Roasters, Inc. Office Supply Distributors may deplete their supply of Game Pieces before others. Limit one (1) Game Piece per eligible Office Manager per Promotion Kit.
How to play the "Online Instant-Win Game": Visit TumblerToss.com for a chance to enter online by providing your email address and the unique Promotion Code from your Game Piece. Then follow the prompts to complete the online registration form, including a valid home address. Eligible participants will then have the option to play the “Tumbler Toss” online game (the “Game”). The results of the Game will not impact an eligible participant’s chances of winning a prize (an “Instant-Win Prize”). The online Instant-Win results will be instantly displayed upon completion of the Game. All potential winners are subject to verification before any prize will be awarded. Administrator is responsible for the functionality of the Game. Limit: One prize per person during the Promotion Period. Each Unique Game Code can be registered only once, and may not be shared or transferred. All online Entrants must read and accept the full Official Rules. Limit: Each participant may enter a maximum of one (1) time per day during the Promotion Period.
The use of automated entry devices of any kind is prohibited and will result in disqualification. Any attempt by a person to obtain more than the permitted number of entries by using the same or multiple/different email accounts will void all of that person’s entries and that person will be disqualified from the Sweepstakes. All entries become the property of the Sponsor. To be eligible for participation in the Sweepstakes, each online participant must input all required data on the Sweepstakes Registration Form. Incomplete or inaccurate entries shall be deemed void. Participants must have a valid email address. P.O. Boxes are not permitted. All entries must be received by no later than 11:59:59 PM ET, August 21, 2012. Limit: One entry per person per day throughout the Promotion Period.
In the event of any dispute regarding the identity of a person submitting an on-line entry, the entry will be deemed submitted by the authorized e-mail account holder, which is defined for purposes of these Official Rules as the natural person who is assigned to an email address by an Internet access provider, online service provider or other organization that is responsible for assigning email addresses for the domain associated with the submitted email address.
Collection and use of personally identifiable information will be in accordance with the Sponsor’s Privacy Policy posted on its Web site.
Prizes and Odds:
Online Instant-Win Game Prizes Available:
There are Ten (10) Online Instant-Win Prize Packages: Each consisting of an office party for 50 people (Approximate Retail Value (“ARV”): $250 each) and a $500 Apple Store Gift Card (ARV: $500 each). Total ARV each Online Instant-Win Prize: $750.00.
ARV of all prizes being offered: $7,500.
Online Instant-Win Prizes will be awarded throughout the Promotion Period. Ten (10) random, computer-generated winning times, one for each Online Instant-Win Prize listed above, will be generated during the Promotion Period. The first eligible participant, using an Office Manager Promotion Code to enter, to submit an entry at or after one of the randomly generated times, will be a potential instant winner of the prize indicated. The time and day of entry, as recorded by Sponsor and the number of entries received will solely determine the odds of winning an Instant-Win Prize.
Notification: Winners of Online Instant-Win Prizes will receive an on-screen notification stating the prize they have won. Within 72 hours, prize winners will receive an email notification with instructions on how to claim and accept the prize. Return of prize or winner notification as undeliverable will result in disqualification.
Winning a prize is contingent upon fulfilling all the eligibility requirements set forth herein. Ineligible prize winners’ prizes and/or undeliverable prizes will not be awarded, except at the sole discretion of the Sponsor.
Winner is responsible for all federal, state, local and income taxes associated with the personal portion of the prize.
Limit: One Prize per person.
Prize Conditions and Limitations: Winners will be requested to contact the Administrator by email and/or by phone within ten (10) days of email notification to accept the prize and coordinate the delivery of the Office Party portion of the prize to Winner’s office location. Office Party portion of the prize must be used by December 21, 2012. The Apple Store Gift Card portion of the prize package will be mailed to the home mailing address provided at entry within approximately 8 - 10 weeks of acceptance of prize. Undeliverable prizes will not be awarded, except at the sole discretion of the Sponsor. If a prize notification or prize is returned as undeliverable, or if winner is found to be ineligible or not in compliance with these rules that winner will be disqualified, and the prize may be awarded to an alternate winner. Sponsor reserves the right to substitute a prize of equal or greater value. No substitution or transfer of prize is permitted, and no cash equivalent for any prize is offered, except at the sole discretion of the Sponsor. In no event shall more prizes be awarded than the number stated in the “Prizes” section above, and fewer may be awarded if insufficient qualified entries are received. Each prizewinner and/or their parent/legal guardian shall be solely responsible for all federal, state and/or local taxes. Terms, conditions, and replacement fees may apply to Gift Card prizes. Gift Card is not redeemable for cash and will not be replaced if lost or stolen. Gift Card usage subject to issuing company’s complete terms and conditions.
Acceptance of a prize constitutes permission from the winner to the Sponsor and its agents to use such winner’s name and/or likeness or a modified name and/or likeness for advertising and publicity purposes related to the sweepstakes, other sweepstakes and their status as winners, in Sponsor’s and/or its agents’ sole discretion, without prior authorization from and without further compensation to Winner, except where prohibited by law. Return of prize or winner notification as undeliverable, failure to respond to notification, failure to reach the winner and/or failure to provide required proof of eligibility, and any other required documentation in a timely manner may result in disqualification and selection of an alternate winner. Non-winning participants will not be notified. Winning a prize is contingent upon fulfilling all the requirements set forth herein.
By entering, each entrant acknowledges and agrees that his/her participation in the Sweepstakes may be subject to, or prohibited or restricted by, his/her employer’s policies and regulations and that the entrant is solely responsible for review of, and compliance with, any such policies or regulations of his/her employer. If a potential winner’s employer prohibits the potential winner’s acceptance of a prize, the potential winner’s entry will be deemed invalid and an alternate potential winner will be randomly selected from among all non-winning entries, time permitting.
Sweepstakes Conditions: This Sweepstakes is subject to all applicable federal, state and local laws. By participating, entrants agree to be bound by these Official Rules and the decisions of the Sponsor and Administrator and waive any right to claim ambiguity in regard to the mechanics of the Sweepstakes or the interpretation of these Official Rules. Winners and entrants also agree to release, discharge, indemnify and hold harmless the Sponsor, its subsidiaries, affiliates, directors, officers, employees and agents and marketing and advertising agencies, from and against any claims, damages or liability due to any injuries, damages or losses to any person (including death) or property of any kind, resulting in whole or in part, directly or indirectly, from or arising in connection with the acceptance, possession, use, misuse or nonuse of any prize offered, or participation in this Sweepstakes.
Sponsor is not responsible for any incorrect or inaccurate information, whether caused by website users or by any of the equipment or programming associated with, or utilized in, this Sweepstakes, or by any technical or human error that may occur in the processing and/or transmissions in the Sweepstakes. Sponsor assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries. Sponsor is not responsible for any problems or technical malfunction of any telephone network or lines, computer online systems, servers or providers, computer equipment, software, failure of email due to technical problems or traffic congestion on the Internet or at any website or combination thereof, including injury or damage to participants or to any other person’s computer related to, or resulting from, participating in or downloading of materials in this Sweepstakes. If, for any reason, the Sweepstakes is not capable of running as planned, including without limitation, infection by computer virus, bugs, worms, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the reasonable control of the Sponsor or Administrator that may corrupt or affect the administration, security, fairness, integrity or proper conduct of this Sweepstakes, Sponsor reserves the right at its sole discretion to cancel, terminate, modify or suspend the Internet portion of the Sweepstakes, and select winners from all Internet entries received up to the time of termination.
Any person attempting to defraud or in any way tamper with the mechanics or logistics or integrity of this Sweepstakes will be declared ineligible and may be prosecuted to the full extent of the law.
Disputes: Except where prohibited by law, all disputes concerning this Sweepstakes will be governed by and construed in accordance with the laws, rules and regulations of the state of New York, without regard to its choice of laws or conflict of laws provisions. Entrants agree that all causes of action arising out of or in connection with this Sweepstakes, or any prize awarded, shall be resolved individually, without resort to any form of class action.
